RENTAL AGREEMENT

BELLO DESIGN AND PARTY RENTALS RENTAL AGREEMENT PRELIMINARIES

 

This agreement governs the client's relationship with Bello Design and Party Rentals, also known as "We," "Us" or "BDPR." 

By accepting it electronically or otherwise, you, or the "Client," agree that you will rent the products offered enumerated (Meaning: An enumeration is a complete, ordered listing of all the items in a collection) within the separate contract invoice that we provide you per that document's terms and this Agreement’s conditions, including:

 

BOOKING, PAYMENTS, AND REFUNDS

 

You must pay half the reservation cost to confirm your rental booking along with concise written directions to the delivery location. The Remaining balance of sale must be paid before the delivery or pick up by 9:00 AM the day of the event. 

If you need to cancel an already-booked reservation, you agree to pay cancellation fees amounting to the following:

  • 50 percent of the contract price when you cancel less than three days before your scheduled delivery time, or

  • 100 %percent of the contract price when you cancel within 1 day of your scheduled delivery time or the day of the event.

  • Full reimbursement will be made if cancellation is  1 week or more before the agreed-upon delivery date with in-stock items.

  • However, any custom-ordered items will be charged full item price if canceled 4 weeks before the event.

 

You agree that once we have dispatched rentals from the BDPR location, refunds will not be granted under any circumstances. You also agree that you will pay for all the services and rental products that we provide, including any damages, losses, or modifications that you or your agents make.

 

RENTAL DELIVERY

For delivery eligibility, your rental order value must total a minimum of $750.00 not including possible additional delivery and labor fees that may apply.

The description and fee for any delivery and “set up” pertains only to the items you are renting from BDPR, no other tasks will be performed by BDPR staff.

                                                                        Payment forms accepted:  

  Upon receiving a delivery, you or your duly authorized agent must verify it in person. You agree to sign off with a BDPR staff member acknowledging your receipt of the delivery and assumption of responsibility for the rental products.

 If you receive rental product in a damaged or otherwise unusable state, you agree that you will provide BDPR with written or telephone notification before your event commences. You also waive your right to seek refunds or any other credits for such rentals if you fail to notify BDPR of the problems in writing before the event. You acknowledge that BDPR will not accept modifications or product exchange requests after our delivery representatives have vacated the drop-off location.

 

 BDPR RESPONSIBILITIES

 

You acknowledge that BDPR is not responsible for breaches of the contract time-frame that are beyond our control, including traffic accidents, vehicular failures, regional/local security issues, or any “acts of God” which include inclement weather. The delivery schedule included in your contract is an approximation that does not constitute a guarantee.

 The descriptions of the rental products that you rent may not perfectly match what you receive due to manufacturer variances, prior usage, and other factors. BDPR may also substitute rental products for other functionally similar offerings at our sole discretion.

BDPR will only be only responsible for the set up and tear down of our products rented 

ACCEPTABLE RENTAL USAGE

You agree not to sublease, rent out or otherwise attempt to loan for remuneration any equipment that you rent from BDPR. Rentals can be held by the party renting for three days max without additional fees unless other arrangements have been made prior with BDPR.

 

YOUR RESPONSIBILITIES CONCERNING DAMAGED BDR PROPERTY

 

During the rental period, you agree that you will cease using any product that becomes unsafe, or you observe it in a state of disrepair. You will notify BDPR of the hazard immediately and continue taking reasonable steps to prevent persons and properties from sustaining injury or damage until our representatives personally relieve you of responsibility for the items.

BDRP is not responsible for any body injuries or property damage when using rental items.

 

LOSS, DAMAGE, AND DESTRUCTION FEES

 

If any BDRP property suffers damage, loss, or destruction, you agree to pay BDPR the entirety of the necessary costs to replace it at retail value. BDPR may let you pay the repair expenses for compromised goods at our sole discretion if we deem it possible and practical to restore them to their original per-rental state.

 We reserve the right to charge up to $250 service fees for each occurrence of damage, including intentional modifications such as painting, stapling, gluing, nailing, or any alterations. We will also bill you for any such items that require excessive cleaning. You are responsible for your guests removing any BDRP items or damaging items.

 

CHARGES AND EXTENSIONS

Except for deliveries made on Fridays, we access rental rates in 24-hour increments. You may request an extension of your rental period by contacting us in writing or an email and obtaining our written approval beforehand. You agree to pay supplemental overtime rates while you retain possession of the equipment, BDPR may waive these additional charges for Friday deliveries that you extend until the following Monday.

 

 

AFTER RENTALS

 

At the end of the rental period, you must return all rental products of BDPR in a state identical to how you originally received products 

  • Do not place any items in a dishwasher to clean.

  • Ensure that linens are returned without stains, burns, candle wax, or other marks and placed in the proper bagging.

  • Pack all other equipment, including attachments and parts, in the same crates and positions that they were received.

  • No alterations are to be done to any rental products.

You agree to return the rental products to BDPR yourself if it is in such a state that prevents pickup at the appointed time and place extra penalties may be applied if you need us to retrieve any equipment outside of the original contract terms.

POST-RENTAL ACTIONS

Within two business days, following the pickup date, BDPR will furnish you with an invoice that details missing and damaged equipment. If you cannot locate the missing rental product within 24 hours, you authorize us to automatically process a payment to the credit card or payment form that you provided.

LEGAL

If claims for damages, injury, or loss arise concerning the rental products, their use, transportation, keeping, malfunction, or loading, you agree to indemnify BDPR. You also acknowledge that you are solely liable for any charges related to such claims or contract terms, including the collection of fees such as, attorney or court costs and expenses that BDPR incurs while enforcing this agreement.

 

By accepting this BBDPR agreement electronically or in person you consent to its terms and conditions in full, and you acknowledge that they pertain to all BDPR invoices regardless of whether such documents include their terms.

 

We reserve the right not to serve a location if, there are safety concerns, or the location is deemed unsafe by law enforcement authorities 

BDPR staff and property will not be at risk of any potential dangers.

 

Balloon  Décor Agreement

Half down on materials needed at the time of booking is required.

Payment in full  is required prior to delivery or pick up of the balloon décor.

Once client approves the photos of the finished product sent prior to the delivery no refund or discount will be given for a change in decision of the set up.

Additional costs will be accrued in the event the client decides to add additional product or balloon structures. The original quote will null and re-quoted for the additional material and accrued inflation and arrangement time.

Delivery fee and additional set up costs will be included in quote.

BDPR staff will not be responsible for putting fastening on any walls, mantels, tiles, wood, plastic.

Customer must take responsibility for the product used to hang the balloon structures.

Customer is responsible for the removal and disposal of such balloons.

For balloon set ups being picked up from our location, there will be an extra wait time fee if client does not show up on the arranged time.

Client must provide a safe parking area for the unloading and set up of the balloon structure and other items rented.

If one is not provided, client assumes any costs that BDPR has incurred while delivery and set up is taking place.

BDPR will not be responsible for any balloon design used outdoors or in elements of heat or cold.

BDPR also reserves the right to have only one adult non BDPR staff individual on location while balloon setup is taking place, this eliminates distractions for our staff.

BDRP is not responsible for any body injuries or property damage when using rental items.

            Fuel Surcharge will be added  $ 1.50 per mile 5 - 70 miles round trip
